Clean Fridays Terms and Conditions

1. Introduction
Welcome to Clean Fridays (“we”, “us”, or “our”). These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Clean Fridays (ABN 33 676 413 942), governing your use of our website located at https://www.cleanfridays.com.au (“Website”) and the services made available through the platform (collectively, the “Platform”). By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Nature of the Platform
Clean Fridays operates as a digital intermediary. Our Platform facilitates connections between individuals or entities seeking cleaning services (“Customers”) and independent service providers offering such services (“Cleaners”).
We are not a cleaning service provider. Clean Fridays does not employ, manage, or supervise Cleaners. Cleaners are independent contractors, and we provide a marketplace to enable Customers and Cleaners to connect and transact. Our role is strictly limited to that of a facilitator.
3. Registration and User Accounts
- All users (Customers and Cleaners) must register and maintain an active account on the Platform.
- You warrant that all information provided during registration is accurate, complete, and up to date.
- You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Bookings and Payments
- Customers may request services by completing a booking form through the Platform. Upon submission, Clean Fridays will notify appropriate Cleaners.
- Once a Cleaner accepts a job, the Customer will be charged the agreed amount. Clean Fridays will hold the payment in escrow until both parties confirm completion of the service.
- Upon dual confirmation (Customer and Cleaner), funds will be released to the Cleaner, less Clean Fridays' platform and service fees.
- Clean Fridays may, at its discretion, cancel a booking or refund a Customer in the event of exceptional circumstances.
4.1. Cancellation Policies
- Cleaner Cancellations:
- If a Cleaner cancels a booking, the Cleaner will receive no payment for the cancelled service.
- Clean Fridays will attempt to find a replacement Cleaner for the same booking if time permits.
- Customers will be offered the option to reschedule their booking to a new date and time.
- Customers will receive a full refund of all monies paid, including the $15 booking fee.
- Customer Cancellations:
- If a Customer cancels a booking, the assigned Cleaner will receive no payment for the cancelled service.
- Customers will be offered the option to reschedule their booking to a new date and time.
- Customers will receive a refund of the service amount, but Clean Fridays will retain the $15 booking fee.
- Refund Processing: All refunds will be processed within 5-7 business days to the original payment method.
- Rescheduling: When rescheduling is offered, customers must select a new date and time within 30 days of the original booking date.
5. Cleaners' Obligations
- Cleaners acknowledge and agree that they are not employees, agents, or partners of Clean Fridays. They operate as independent contractors.
- Cleaners must:
- Maintain valid ABNs (if applicable), insurances, licenses, and permits as required by law;
- Supply their own equipment and cleaning materials unless otherwise agreed;
- Deliver services professionally, competently, and lawfully;
- Release Clean Fridays from any obligation to withhold or remit any taxes.
6. Customers' Obligations
- Customers must:
- Provide safe and lawful access to the premises;
- Offer accurate, truthful, and sufficient instructions and information;
- Not engage in discriminatory, threatening, or unlawful conduct toward Cleaners.
7. Dispute Resolution
- In the event of a dispute between a Customer and a Cleaner, both parties agree to promptly notify Clean Fridays and provide reasonable evidence related to the dispute.
- Clean Fridays, acting as an impartial facilitator, may review the matter and offer a resolution based on available information. The decision made by Clean Fridays is final within the Platform context.
- Clean Fridays is not a party to the contractual arrangement between Customer and Cleaner and bears no legal liability for the conduct or outcome of such services.
- If either party is dissatisfied with the decision, they retain the right to pursue civil or legal remedies against the other party. Clean Fridays is indemnified against any claims, demands, proceedings, damages, losses, or costs arising from such disputes.
8. Limitation of Liability
- To the maximum extent permitted by applicable law, Clean Fridays disclaims all liability for any direct, indirect, incidental, special, or consequential loss or damage arising out of or relating to your use of the Platform.
- Clean Fridays does not guarantee the quality, suitability, safety, or legality of services provided by Cleaners.
- The Platform is provided on an "as is" and "as available" basis. We make no warranties or representations about the operation of the Platform or the accuracy of any content therein.
9. Termination
- Clean Fridays reserves the right to suspend or terminate your account or access to the Platform at any time, with or without cause or notice, including but not limited to breaches of these Terms.
10. Amendments
- Clean Fridays may modify these Terms at any time by posting updated Terms on the Website. Continued use of the Platform after such posting constitutes acceptance of the revised Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes must be resolved in the courts of Victoria, and you agree to submit to their exclusive jurisdiction.
